SECTION 2 – PRODUCT ACCURACY & WELLNESS DISCLAIMER

2.1 Visual Representation: We have made every reasonable effort to display the dimensions, contours, materials, designs, specifications, and colors of our sleep masks, earplugs, and other wellness accessories as accurately as possible.

However, because display monitors render colors differently, minor variations between the appearance of a product on your screen and the physical product may occur.

Product descriptions, materials, dimensions, and specifications are provided to help customers make informed purchasing decisions. Nothing in this section limits your statutory rights if a product does not conform to its advertised description.

2.2 Non-Medical Wellness Disclaimer: SENKOKU products, including sleep masks and noise-reducing earplugs, are designed as non-medical comfort and wellness accessories intended to support relaxation, rest, light reduction, and everyday noise management.

Unless expressly identified otherwise, SENKOKU products are not marketed as medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition or sleep disorder, including clinical sleep apnea, chronic insomnia, hearing disorders, or eye diseases.

Our products are not substitutes for professional medical advice, diagnosis, or treatment.

If you suffer from a chronic medical, ophthalmological, auditory, or other relevant health condition, consult a qualified healthcare professional before use.

2.3 Earplug Use and Safety: Customers must follow the instructions and care recommendations provided with their earplugs, including any guidance concerning insertion, removal, cleaning, maintenance, and replacement.

Noise-reducing earplugs may reduce certain external sounds but do not guarantee complete silence or total elimination of environmental noise.

Unless a product is expressly certified and marketed for a particular protective purpose, it must not be relied upon as certified hearing protection for hazardous noise environments.

Customers should exercise caution when using earplugs in situations where hearing alarms, warnings, approaching vehicles, or other important environmental sounds is necessary for personal safety.

SECTION 3 – ORDERS, ACCEPTANCE & CANCELLATION

When you submit an order through our store, you make an offer to purchase the specified merchandise.

SENKOKU reserves the right to decline or cancel orders for legitimate reasons, including pricing errors, suspected fraud, unauthorized payment activity, stock unavailability, or delivery restrictions, subject to applicable consumer protection laws.

Upon successful order placement, an automated order confirmation will be sent to your email address.

Unless otherwise clearly stated during checkout, the purchase contract is formed when SENKOKU confirms acceptance of your order by dispatching the goods.

If we cannot accept an order for which payment has already been collected, we will notify you and arrange an appropriate refund without undue delay.

Customers may request an order cancellation before dispatch by contacting contact@senkoku.com. We will make reasonable efforts to accommodate such requests.

Once an order has been dispatched, applicable statutory withdrawal rights and our Return & Refund Policy will govern cancellations and returns.

Purchases made through SENKOKU are primarily intended for personal, end-user consumption. Orders intended for commercial resale or distribution may require prior authorization, subject to applicable law.

SECTION 4 – PRICING, VAT & PAYMENTS

4.1 Pricing & Value Added Tax (VAT): Retail prices displayed on our European storefront are presented in Euros (€), or another currency where indicated.

Prices displayed to consumers include applicable VAT and other mandatory taxes where required by law.

Shipping costs, optional express delivery fees, and any additional mandatory charges will be disclosed before the customer submits an order.

Where applicable, customs duties, import taxes, or other charges for destinations outside the European Union will be disclosed in accordance with applicable consumer information requirements.

4.2 Payment Authorization: You agree to provide valid, current, and complete payment details when making a purchase.

By submitting payment through an available payment method, including credit or debit card, PayPal, Klarna, Apple Pay, or Google Pay, where offered at checkout, you confirm that you are authorized to use the selected payment method.

Payments are processed through authorized payment service providers, subject to their applicable terms and security procedures.

SENKOKU will not impose payment surcharges prohibited by applicable consumer protection laws.

SECTION 5 – SHIPPING, DELIVERY & RISK OF LOSS

5.1 Delivery Estimates: Estimated delivery timeframes are communicated through our website, product pages, checkout process, or order confirmations.

SENKOKU makes reasonable efforts to dispatch and deliver orders within the stated delivery periods.

Unless a different delivery period has been agreed upon, goods will be delivered without undue delay and no later than 30 calendar days after the conclusion of the contract, as required under applicable EU consumer protection laws.

If delivery is delayed beyond the agreed timeframe, customers retain their statutory rights, including the right to request delivery within an appropriate additional period and, where legally applicable, terminate the contract and obtain reimbursement.

Delivery delays caused by circumstances beyond our reasonable control will be addressed in accordance with applicable law and will not automatically remove customers' statutory rights.

5.2 Transfer of Risk (EU Consumer Compliance): In accordance with applicable European Union consumer protection laws, the risk of loss or damage to goods generally remains with SENKOKU until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

Where the customer independently commissions a carrier not offered by SENKOKU, the transfer of risk may occur upon delivery of the goods to that carrier, as permitted by applicable law.

SECTION 6 – 30-NIGHT TRIAL & STATUTORY RETURNS

Eligible SENKOKU sleep wellness products, including sleep masks and earplugs, are covered by our voluntary 30-Night Sleep Guarantee, subject to the eligibility, hygiene, condition, and inspection requirements described in our Return & Refund Policy.

This voluntary guarantee provides additional benefits and does not replace or restrict statutory consumer rights.

6.1 EU Statutory Right of Withdrawal: Consumers purchasing online generally have the right to withdraw from eligible purchases within 14 calendar days of receiving their goods, without providing a reason, subject to applicable legal exceptions.

Certain sealed products that are unsuitable for return due to genuine health protection or hygiene reasons may be excluded from the statutory right of withdrawal after the seal has been broken, where the applicable legal conditions are satisfied.

6.2 Earplug Returns: Earplugs returned under our voluntary 30-Night Sleep Guarantee must be thoroughly cleaned, properly maintained, hygienic, and free from physical damage, deterioration, or excessive wear.

Returned earplugs will undergo a hygiene and condition inspection at our facility to assess whether they meet our established restocking eligibility standards.

Refunds under the voluntary guarantee may be declined if the returned earplugs fail this inspection.

These additional voluntary guarantee requirements do not restrict mandatory statutory rights concerning defective, damaged, or non-conforming goods.

SECTION 7 – INTELLECTUAL PROPERTY RIGHTS

Such content may be protected under applicable copyright, trademark, and intellectual property laws.

If you submit product reviews, testimonials, photos, suggestions, or comments ("Feedback") to SENKOKU through our website, email, or social media channels, you grant SENKOKU a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and publish that Feedback for legitimate business purposes, including operating our website, improving our products, and presenting customer reviews.

Where the use of Feedback involves personal information, identifiable photographs, testimonials in advertising, or other processing requiring a lawful basis under applicable data protection legislation, SENKOKU will comply with the requirements described in our Privacy Policy and obtain consent where legally required.

Consumers in the European Union benefit from a minimum two-year legal guarantee for qualifying goods.

11.2 Limitation of Liability: To the extent permitted by applicable law, SENKOKU will not be responsible for losses resulting solely from circumstances beyond our reasonable control or from the customer's improper use of products contrary to clearly provided safety and care instructions, where SENKOKU is not legally responsible for those losses.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury where such liability cannot lawfully be excluded, defective products where mandatory product liability rules apply, or any other liability that cannot be excluded or restricted under applicable law.

Nothing in these Terms reduces the remedies available to consumers under mandatory consumer protection legislation.

SECTION 12 – INDEMNIFICATION

To the extent permitted by applicable law, you may be responsible for losses or damages directly resulting from your intentional unlawful conduct or material breach of these Terms, where such responsibility is established under applicable law.

This provision does not require consumers to indemnify SENKOKU for losses caused by SENKOKU's own acts or omissions, or for liabilities that cannot lawfully be transferred to consumers.

SECTION 13 – SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is determined by a competent court or authority to be unlawful, invalid, or unenforceable, that provision shall not be binding to the extent of its invalidity or unenforceability.

The remaining provisions shall continue to apply where legally permissible.

These Terms, together with our Privacy Policy, Return & Refund Policy, and other applicable policies incorporated into the purchase process, govern the use of our Services and the contractual relationship between SENKOKU and its customers.

Nothing in this section limits mandatory statutory rights.

SECTION 14 – GOVERNING LAW & DISPUTE RESOLUTION

14.1 Applicable Law: These Terms of Service and purchase agreements entered into with SENKOKU shall be governed by the laws of Cyprus, subject to the mandatory consumer protection provisions applicable in the customer's country of habitual residence where required by law.

14.2 Consumer Protection Reservation: Consumers habitually residing within the European Union retain the protection of mandatory consumer protection laws applicable in their country of residence.

Nothing in these Terms restricts consumers from pursuing claims before courts or competent authorities where they are legally entitled to do so.
